Patent Application Closer to Approval IPEA Reports; All Claims Have Novelty, Inventive Step, and Industrial Applicability
CHICO, CALIF. (September 30, 2003)-Advanced Light Technologies, LLC has been notified by the International Preliminary Examining Authority (IPEA) that all 19 claims of U.S. Patent Application 8422/5 have novelty, inventive step, and industrial applicability. Under the terms of the Patent Cooperation Treaty, the IPEA reports this information to the World Intellectual Property Organization, which in turn transmits it to government patent offices around the world.

Advanced Light Technologies filed for this patent in 2001, for a medical, agricultural, and industrial application to cover the process of identifying and exploiting differential absorption.

Quoting from the IPEA report: "Claims 1-19 meet the criteria set out in PCT Article 33(2)-(3), because the prior art does not teach or fairly suggest the steps of identifying the heat capacity of the target and of the host in a combination of steps of selectively exciting a target in a host by exposure to electromagnetic radiation that is differentially absorbed. Claims 1-19 meet the criteria set out in PCT Article 33(4), and thus have industrial applicability because the subject matter claimed can be made or used in industry."
